On August 20, Nancy Litwak was successful in obtaining summary judgment for an architectural client in a multi-million dollar, sixteen-party construction defect case. Ms. Litwak represented the architect of record on a commercial renovation project, which took place in Charlotte over the past several years. Ms. Litwak obtained a favorable ruling from the judge at the time of the hearing, which dismissed the firm’s client from the lawsuit one month prior to trial. Ms. Litwak demonstrated, and the court agreed, that the opposing party had failed to establish any of the necessary elements of the claims asserted against the architect. Ms. Litwak’s argument was based on North Carolina law relating to professional negligence claims against architects, including what evidence an opposing party has to show to bring such a claim against an architect in North Carolina.
