CONSTRUCTION LITIGATION
Rosenwood Rose attorneys have extensive experience negotiating construction agreements, advising on issues that arise during the design and construction process, and resolving construction disputes through litigation or arbitration if necessary. We frequently present at seminars on risk management and best practices, and we serve as mediators and arbitrators for construction disputes. From schematic design through issuance of a certificate of occupancy, we participate in and understand all phases of the construction process and the issues that commonly arise in connection therewith. Our clients include owners, contractors, architects, engineers and other design professionals, sureties and insurers.

Obtained a multi-million dollar arbitration award for Harrah’s Cherokee on a construction defect claim involving precast concrete parking garages.

Obtained a multi-million dollar settlement on behalf of a private equity group on a mixed-use development experiencing water intrusion in the residential condominium tower and structural issues at the parking deck.

Obtained a defense verdict ($0) on behalf of an architect on a nearly one million dollar claim for breach of the standard of care.

Obtained dismissal on summary judgment on behalf of an architect on a multi-million dollar claim for breach of the standard of care and professional negligence.
