BUSINESS & CIVIL LITIGATION
When your business is threatened by a legal dispute or needs to sue to enforce its rights, you need someone who knows how to manage your dispute so that you can continue to focus on running the business. Rosenwood Rose attorneys serve as trusted team members for your business every step of the way, and we understand that every legal problem is also a business problem which needs to be handled from that perspective. We will resolve your issue in the way that is most beneficial to your business, advise on ways to prevent reoccurrence, and counsel you and your employees through every step of the process. Many of our long-term clients think of us as their general counsel, trusting us to understand their businesses and to deal with any legal issues with minimal oversight and involvement. Whether you want to be highly engaged in the process, with constant reporting and updates, or “just want it go away”, we are here to serve.
Our clients include small business owners, large multi-state conglomerates, manufacturers, professional service providers, private equity groups, and developers. We advise our clients on corporate governance, vendor contracts, mergers and acquisition, condemnation, owner transitions, contract disputes, EEOC claims, insurance disputes, intellectual property rights, professional liability, and white-collar crime and embezzlement. Our practice also involves both upholding and attacking restrictive covenants, such as non-compete provisions, for our clients.
Our Business and Civil Litigation practice also includes providing counseling and in-house seminars on best practices and risk assessment, allowing clients to head off situations that might result in litigation before it occurs.
REPRESENTATIVE MATTERS:
-
Defense counsel for one of the largest property management firms in the Southeast in an attempted class action lawsuit striving to create new law extending Debt Collection Practice Act protections to dues collection and accounting practices. We successfully had all federal statutory claims dismissed and the case thrown out of federal court, defeated the attempt to have a class certified which was upheld by North Carolina Court of Appeals and Supreme Court, and successfully disposed of the sole remaining state statutory claim. We were also able to recover 100% of our client’s costs and attorneys’ fees.
-
